The Supreme Court Just Erased Part of the Constitution

To go along with Heather Richardsons Letter there's this article from David French at the NY Times. Free access.

  • "....unless and until Congress passes specific legislation to enforce Section 3..."

Ah, there's the rub. SCOTUS just created a new requirement out of thin air. FECES.
  • Really good column from David French. Like it that he noted what the court did was "invert" the role of Congress in 14A - i.e., flipped the whole thing upside down.

Thanks for sharing the article, Mark!
This Supreme Court ruling is disappointing.
Section 3 of the 14th Amendment is, in effect, null and void until Congress enacts corresponding legislation.
Other Reconstruction-era amendments are self-executing - they do not rely on any legislation.
