Might Tariffs Get “Overturned”?

Somebody’s paying the tariffs. Looks like it’s you.

    Good catch, @Mark.

"The 11 jurists appeared to be skeptical of the government’s arguments ...."

So most? all? of the court is hearing it? That should mean the scenario of the three-judge panel, two of which are Trumpers, is off the table, and it's more likely the case could be decided on the merits.

On the merits, the Dumpsters are losers.

It will undoubtedly be taken by Trump to his "Supreme" Court:

"THIS SUPREME COURT IS THE BIGGEST, BEST AND MOST SUPREMEST COURT IN THE HISTORY OF THE UNITED STATES, and IT'S ALL MINE !!!)
  • FWIW, I've been very interested in this case since it was filed and slowly worked it's way up the chain. My guess is that it's going to be Roberts's call, and he is unpredictable as far as I'm concerned.
  • I would like to see this turned around for the sake of 'rule of law', and many other reasons.

LAST for tonight. SOON the U.S. will be surrounded by the TARIFF curtain. 42 minutes.

  • Barry Ritholtz does a great job describing the lay of the land.
The following WSJ article provides details from today's case in the U.S. Court of Appeals for the Federal Circuit.

  • Wow. Section 338 is surely heading our way next. Talk about "vague"... "Discrimination against US commerce" could mean anything that he wants it to. And how would you even begin to challenge that in a court?

Thanks for the additional info, @Bee. The issue could be in the courts for years, apparently.
  • I do not see how of all of them, the Brazilian ones stand. DJT has admitted why he imposed them and his reasons have nothing to do with any of the legal requirements.
  • I have quit depending on the Constitutional or legal when the SCOTUS can just decide particular presidential actions are not subject to judicial review even if 100% of other Constitutional scholars and legal experts disagree.
  • @Anna- Yes, exactly.
  • Tariff excuse #6, I feel like it and I own the courts as Anna stated.
  • As the economy unravels, we will hear a lot more of "It had to be done". As if making us economically weaker accomplishes anything. Ot that they are fighting the "good fight". No proof will ever be forthcoming.

President Trump says US court ruling against tariff authority 'would be 1929 all over again'. If tariffs are overturned, $100B would have to be returned, which means more T bill sales. I think this was a warning to Appeals Court and Supreme Court that a depression will occur and the courts will be to blame. My guess is that 60% chance appeals court rules against tariffs, but 95% chance Supreme Court rules court has no authority.

Shithead owns the supremes, the DOJ, congress and all other levers of power. He will soon own the BLS and everything else. . He is getting away with whatever he wants to do and getting virtually no serious resistance. He can tell networks what they can do and universities what they can teach . And sickeningly,,,, he is only getting started. It’s way bigger than tariffs ,,, by design or incompetence or madness or retribution he is burning the whole house down. Anyone disagree?
  • Not me... but I'm thinking you already knew that.
