Supreme court declines to expedite decision on Trump’s immunity claim in 2020 election case

The Guardian is reporting that the Supreme Court has given Trump a crucial victory as he seeks to delay his trial as much as possible :

The US supreme court on Friday rejected a request by the special counsel to expeditiously decide whether Donald Trump has immunity from federal prosecution over his efforts to overturn the 2020 election results, before a lower appeals court issued its own judgment.

The decision means the case is returned to the US court of appeals for the District of Columbia (DC) circuit, and the case against Trump remains frozen pending the outcome of the appeal.

In declining to leapfrog the lower court and fast-track the case, the supreme court handed a crucial victory to Trump as he seeks to delay as much as possible his trial, currently scheduled for next March in federal district court in Washington DC.

    A bit harsh guys. Bloomberg has aired a couple experienced attorneys this week & today who are quite optimistic the rule of law will prevail. They think the SC believes the lower Appeals Court will rule against DT based on its composition and past precedent. So, the SC may eventually just decide to let the lower court decision stand, or might later reaffirm the ruling.

    I don’t think anyone knows at this point how all of this will work out.
  • Some very good points there, @hank- that makes a lot of political sense- the Supremes just sit there and let the Court of Appeals take all of the heat. Given the jurisdiction, that could very well be what goes down.
  • OK. But... delay, delay, delay, prevaricate, lie, misrepresent, delay some more and then watch the statute of limitations run out. This Orange Abomination needs to be in a prison jumpsuit. AAAAaarrrgghh!

    Yep. DC appellate court will laugh total immunity out of the courtroom, the trial prep will continue toward the March date, and next term the SC will have its say ... or will decline to take the case. Not doing anything now may be a sign that the latter is more likely.

    Beer boy and Gorsuch aren't completely slam dunks on every far-right issue, either. Roberts being so scared of the political-hacks characterization of "his" court is another possible plus. And even if they're thinking in purely political terms, the next Rs up are plenty rabidly right-wing for their purposes; Dump is not essential for the campaign to take us back a couple of centuries.

    P.S. Or maybe I'm being overly optimistic because it's finally, really snowing this morning, here in snow country with zilch this season beyond two light dustings earlier that melted away almost immediately.

    Thanks for the input Andy. Thomas is an embarrassment to the court of course. None of them is perfect. But the courts are our best and only defense against utter chaos and uncivility. A lawyer friend once remarked: “That’s what separates us from the barbarians.”

    In this part of the state many hard-right supporters are loud, pushy and obnoxious. They disrupt civic proceedings and leave some public servants in tears. Many armed to the teeth. We can only hope the vast majority of citizens will reject this hard right mob mentality. If they don’t, it will say more about we as a people than it does about any particular candidate.

    No doubt - The cases before the judiciary are profound.
