  • Was there another thread about Kimmel that was deleted? Did that have something to do with the site outage yesterday?

    I believe that Trump and ABC have handed Kimmel a massive lawsuit on Constitutional grounds. I believe that even this SCOTUS will not let this stand. They will know that they cannot set that precedent. The FCC chairman made it clear that this is a government intrusion on The First Amendment.

    It would not even be surprising to find out that ABC is working with Kimmel to create a case for this to go to SCOTUS. That this is part of a plan to bring it all to a head. That, I know, is conjecture, but we shall see. Guaranteed that ABC provides testimony that the FCC demanded this assault on Kimmel's speech. And Guaranteed Kimmel has now employed a team of lawyers. maybe paid for by ABC.

Most of the current SCOTUS has abandoned the law, precedent and the constitution to appease 47 and they are on a course of making it up as they go. Very disheartening to say the least.

    I understand how you may see it that way. But, this is a slam dunk First Amendment violation. That sort of precedent will be very hard for even conservative legal scholars/observers to swallow. The outrage from their own quarters would be significant. I am not talking here about following precedent, rather setting it. A much bigger deal.

    The only thing that tis SCOTUS loves more than Trump, is their personal credibility. And that is hanging on by a thread. This would define their legacy as illegitimate, even among their own kind. Anyhow, that is my current thinking.

    I might add that under oath, the FCC chairman will absolutely point the finger at Trump, as the originator of this policy. And Trump's own words will support it.

    Also, it comes in little vials (sometimes pouches), these days, not "bags". lol

  • I would add that the FCC Chairman's phrasing will not go in their favor. It "appears" Kimmel "misled". So weak, as to be laughable.

    Again, I understand I am being optimistic here. Anything else at this point is to give up on Democracy entirely. I am not quite ready to do that.

    Apparently it was a comment that MAGA is trying to characterize the shooter as being anything but one of their own. The shooter grew up in a family of Trump supporting gun shooters. That's what I've gleaned from the vague reporting I've read.

    It is a giant nothingburger. If you are looking for a smoking gun there is none. Even "hate speech" is protected, and this came nowhere close to that. I think that ABC was threatened with license revocation, and chose to let this play out in the courts. And I think they have evidence to prove it. Trump's words will hurt their case, as well. He is indeed the "Mad King".

    More importantly, Kimmel's words do not matter. They could be cause for a private entity, such as ABC, to unilaterally take him off the air. A business decision. But, the government cannot demand that they do so.

    And these dimwits in government shot themselves in the feet by admitting what they did, and why. And saying that "they were not done". I believe that the only way they win this is by cancelling the First Amendment.

    I don’t view any of these late night comics. SNL occassionally. I get the impression the murder of Charlie Kirk was referenced directly or indirectly by Kimmel several times at different parts of the program. So without viewing the entire show one may not get a clear idea of how Mr. Kimmel approached this. I defend his right to broadcast whatever he wants. Free speech. Yes. To be clear, Trump and his supporters took offense at Kimmel’s remarks. But it was Disney, who owns ABC, who suspended the show.

    As I said yesterday in the now missing thread, I don’t think it’s appropriate for stand-up comics to be referencing any national tragedy of this magnitude for laughs - even if indirectly as Kimmel mostly did. I would have started the first show after the event with an expression of condolences to the family, friends and supporters of Charlie and then moved on. It’s not a news program like PBS’s News Hour or Washington Week, where there’s a lot of fact-checking, comments are aired contextually in their entirety, and those with differing interpretations have a chance to voice their view. I’d guess Kimmel may have spent two or three minutes total making remarks about what happened. Not enough to seriously address the facts and implications. A national tragedy. Kimmel’s “free speech” landed him a suspension. Charlie’s “free speech” cost him his life and altered indelibly the lives of the 3,000 college students unfortunate enough to witness the horror.


    Below is what I’ve been able to string together from different sources. FWIW

    (Unknown sources / possibly Bloomberg):

    ”We hit some new lows over the weekend with the MAGA gang trying to characterize this kid who killed Charlie Kirk as anything other than one of them and doing everything they can to score political points from it,” Kimmel said during his show’s Monday monologue.

    “In between the finger-pointing, the White House flew the flag at half-staff, which got some criticism, but on a human level, you can see how hard the president was taking this.”

    The show then cut to a clip of President Trump being questioned by a reporter outside the White House where he was asked how he was holding up in the wake of Kirk’s assassination.

    The commander-in-chief said, “I think very good,” then changed the subject to renovations being done to the White House ballroom, before cutting back to Kimmel.

    “He’s at the fourth stage of grief: construction,” the late-night host quipped.


    And (From WSJ): Kimmel was also critical of President Trump’s grieving process for Kirk, which he said was akin to “how a 4-year-old mourns a goldfish.”

    Not only was Kimmel not wrong about Trump's seeming lack of real concern. He was not wrong that MAGA tried to immediately lay the act of a disturbed individual at every Democrat's feet. Nor was Kimmel wrong about the hypocrisy in this heinous act versus other heinous acts that did not involve one of their own. To whit, I would submit Alex Jones, in general terms. There was no right-wing outcry regarding his attempt to mislead the world about the murder of teachers and children. Those grieving parent's were even subjected to harassment, as a result. Similar acts also occurred with Uvalde.

    Apparently, "Good people on both sides", only applies when trying to defend white supremacy. This was not an act of a group at all. It was an act of a seemingly unstable individual. There was no conspiracy, or supporting organization. Or is the "entire right-wing" now taking responsibility for the Oklahoma City bombing. Shall we declare all militias "terrorist" organizations and start rounding them up?

    Kimmel is a comedian, first and foremost. His commentary, like Lenny Bruce's, is protected speech. And if Disney or ABC was threatened by the government, which the FCC chair pretty well confirmed, this becomes a blatant First Amendment violation of the highest order. It has "the appearance" of having emanated from the very top.

    If ABC/Disney is not playing along to force a First Amendment showdown, they are complete idiots and will be defendants in any forthcoming legal actions. I will give them the benefit of a doubt, that they have great legal representation, and are not that stupid. Until we find out otherwise.

    The Epstein thing will not go away. It is a conspiracist's dream issue. And a gift that will keep on giving. Sort of a Frankenstein's monster for this administration. A bit like a tire fire that cannot be extinguished.

    $$$$ it's always about $$$ -- Nexstar wants a merger approval so they have to kiss T's ass to get it. They started this stink by saying they won't carry ABC on their stations. Paramount did the same thing to Colbert to get their merger approved. The thing I don't like it the FCC rules state one company can not reach more than 39% of households. The FCC may change that rule for this merger. I read that would give Nexstar access to 80% of households and that's scary. Whether right or left leaning, no company should have that much household access. I recently read CNN could possibly be taken over by a right leaning owner. Can you say oligarchy?

    Now CNN and FoXNews can compete for the biggest Trump butt-smooching award.

    They will be competing for eyes among an aging conservative population, who still pays for cable. A battle for irrelevancy, that ends in extinction. Like a couple dinosaurs fighting, as the killer asteroid bears down upon them.

    But Sinclair, which owns many ABC affiliates (and my local station), says it won’t carry the show. I think we can all learn a lot from the affair. Glad ABC is putting him back on the air, even though I probably won’t be able to watch.
